Terms of Service
Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the codehooks.io website (the "Service") operated by CODEHOOKS AS ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of CODEHOOKS AS and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CODEHOOKS AS.

CODEHOOKS AS has no control over and assumes no responsibility for the content, privacy policies, practices, or compliance of any third-party websites or services. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Data Processing and Privacy Terms
Data Processing and GDPR Compliance
1. Data Controller and Processor Relationship
1.1 When you use our Service, the relationship between you and CODEHOOKS AS regarding personal data processing depends on how you use the Service:
- You as Data Controller: When you collect, store, or process personal data of your end users through our Service, you act as the Data Controller and CODEHOOKS AS acts as your Data Processor.
- CODEHOOKS AS as Data Controller: For your account information, billing data, and service usage data, CODEHOOKS AS acts as the Data Controller.
2. Data Processing Agreement (DPA)
2.1 This section constitutes our Data Processing Agreement under Article 28 of the GDPR for situations where CODEHOOKS AS processes personal data on your behalf.
2.2 Processing Instructions: CODEHOOKS AS will only process personal data on your behalf in accordance with your documented instructions provided through:
- Your use of the Service features and functionality
- Your API calls and database operations
- Your configuration settings
- Written instructions provided to our support team
2.3 Categories of Personal Data: The personal data processed may include any data you choose to store or process through the Service, which may contain:
- Contact information (names, email addresses, phone numbers)
- User identifiers and authentication data
- Application-specific data as determined by your use case
- Any other personal data you input into the Service
2.4 Categories of Data Subjects: Data subjects may include your end users, customers, employees, or other individuals whose personal data you process through the Service.
2.5 Processing Activities: CODEHOOKS AS may process personal data for the following purposes:

3. Data Processor Obligations
3.1 Confidentiality: All personnel authorized to process personal data are bound by confidentiality obligations.

3.3 Sub-processors: CODEHOOKS AS may engage sub-processors to assist in providing the Service. Current sub-processors include:

4. Data Location and Transfers
4.1 Data Location: All personal data is stored and processed within the European Union/EEA.

5. Data Retention and Deletion
5.1 Retention: CODEHOOKS AS retains personal data only as long as necessary to provide the Service or as instructed by you.
5.2 Deletion: Upon termination or request, CODEHOOKS AS will:
- Delete or return all personal data processed on your behalf
- Delete existing copies unless retention is required by law, in which case data will be securely isolated
- Complete deletion within 2 weeks
6. Audits and Compliance
6.1 Documentation: CODEHOOKS AS maintains records of processing activities as required by GDPR.
6.2 Audit Rights: You may audit CODEHOOKS AS’s compliance once per year, with 30 days’ prior notice, during business hours, and subject to confidentiality. Costs are borne by you unless a material breach is identified.
7. Your Obligations as Data Controller
You warrant that:

- You have provided privacy notices to data subjects
- You have obtained necessary consents
- You comply with applicable data protection laws
You are responsible for:

8. Liability and Indemnification
Each party is liable for its own compliance with applicable laws.
CODEHOOKS AS’s liability for data processing is limited to its role as Data Processor.
In all cases, CODEHOOKS AS’s aggregate liability is capped at the total fees paid by you in the 12 months preceding the claim.

(i) your access to or use of or inability to access or use the Service;
(ii) conduct or content of third parties;

(iv) unauthorized access, use, or alteration of your transmissions or content.
CODEHOOKS AS’s total liability is capped at fees paid by you in the 12 months preceding the claim.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or performance.
We do not warrant that:
a) the Service will function uninterrupted, secure, or available at all times;
b) errors or defects will be corrected;
c) the Service is free of viruses or harmful components;
d) results of using the Service will meet your requirements.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Norway, without regard to conflict of law provisions.
Our failure to enforce any right will not be considered a waiver. If any provision is held invalid, the remaining provisions remain in effect. These Terms constitute the entire agreement between us regarding the Service.
Changes
We may modify these Terms at any time. If changes are material, we will provide at least 30 days’ notice prior to new terms taking effect (via email or in-app notification).
By continuing to use the Service after revisions become effective, you agree to the revised terms. If you do not agree, please stop using the Service.
